Product Exchange – Terms and Conditions

This voluntary product exchange program (“Program”) shall be valid until stocks last or till the Program expires, whichever is earlier. By participating in this Program offered by Eureka Forbes Limited (“Eureka Forbes”), You (“the Customer”) agree to the following terms and conditions:

1.    ‘Product’ shall mean and include either water purifier or vacuum cleaner of Eureka Forbes as provided in Annexure A.

2.    “Used Product” shall mean any water purifier or vacuum cleaner that is owned by You at the time of exchange with a new Product.

3.    Ownership and Legality: You confirm that You are the sole and absolute owner of the Product mentioned for exchange.

4.    Service availability: Exchange is available only for select pin codes, details of which will be provided at the time of placing the order on the Eureka Forbes website. Eureka Forbes shall bear no liability for pin codes outside the serviceable area.

5.    Qualification for exchange: 

(i)    A vacuum cleaner can only be exchanged with a vacuum cleaner and a water purifier can only be exchanged with a water purifier.

(ii)    If the exchanged item does not qualify for pickup, your order will be cancelled, and the new Product will not be delivered. You will receive a communication on your registered email address/mobile number of such cancellation. If no email address is registered, You will receive an intimation on the email address/mobile number used at the time of purchase of the Product.

a.    In the event You refuse to return/exchange the used Product at the time of delivery of the new Product or if it is determined at the time of delivery that the used Product is different or does not conform to the conditions specified herein, You agree that the transaction and the exchange Program availed by You shall stand cancelled.
 

(iii)    Product condition: You confirm that  the Product You are exchanging under this Program is genuine and not refurbished or counterfeit. 
 

(iv)    Exchange Process: You understand that the Used Product under exchange is being exchanged by Eureka Forbes solely in exchange for the purchase of the new Product from Us. There is no additional consideration due to You from Eureka Forbes for participating in the Program.
 

You agree not to bring any claim against Eureka Forbes and its affiliates, retailers, the buyback partner(s), and any future purchaser of the used Product in relation to the adequacy of the value (if any) of the used Product provided as part of the Program. In the event You do not agree with the value provided to You for the used Product, You agree not to avail the Program.

(v)     Indemnification: You agree to indemnify and keep indemnified Eureka Fobes, its affiliates, distributors, retailer and the buyback partner (if any), against all third-party claims, demands, costs, expenses (including attorney fees), suffered, incurred, undergone and/or sustained by Eureka Forbes, its affiliates, distributors, retailer and the buyback partner (if any) due to:

a.    usage of the used Product by you;
b.    return of a different product or if the used Product does not meet the conditions prescribed herein or if the condition of the used Product is different from the condition specified at the time of availing the Program; and
c.    any breach of these terms and conditions.

(vi)    Personal Information: You consent to the processing, transfer, and retention of your personal information provided in connection with this Program run by Eureka Forbes and other entities involved in managing the Program, for the purpose of validating the information and administering the Program.
 

(vii)    Non-Return of Device: Once You hand over the used Product to the delivery associate, for exchange You agree and acknowledge that under no circumstances will the used Product be returned to You.
 

(viii)    Different Yields: You understand that different exchange values will be provided for different Products.
 

(ix)    Simultaneous Exchange: The new Product delivery and used Product exchange will occur simultaneously ("hand in hand"). You agree to keep the used Product ready for exchange. If a replacement Product is not available, You understand that the Exchange Program shall stand cancelled.
 

(x)    The delivery of the new Product will be completed once the delivery associate successfully completes the verification and collects the used Product from You.
 

(xi)    Shipping Charges: You understand that You are responsible for paying pickup charges towards shipping of the used Product, as mentioned on the checkout page. These charges are in addition to the exchange value of the used Product.
 

(xii)    Eureka Forbes reserves the right to amend these terms and conditions periodically. Warranty (if applicable) for the used Product shall terminate at the time of exchange. Warranty Terms and Conditions as applicable on the new Product shall prevail as per the warranty terms provided with the Product.
