Terms and Conditions

  • Share a smile referral Program (“Program”), is open to existing customers (“Customer”) who have an existing relationship with Eureka Forbes Limited (“EFL”). Under this program, the Customer can refer any person who is a resident of India who wishes to buy an EFL product. The Customer who refers a prospective customer/s to the EFL is hereinafter referred to as “Referrer”. The prospective customer is referred to as “Referee”.
  • Under the Program, the Referrer will be entitled for a reward (“Reward”) for each successful transaction i.e. successful purchase of an EFL product by a Referee using the referral code of the Referrer through Direct Selling Channel or through online www.eurekaforbes.com (“web portal”).
  • The applicant (potential Referee) from the Program should input the referral code in the JOS application / web portal for being eligible for the program. EFL will not facilitate any request of tagging a successful application to a referral code at any future date.
  • If more than one “Referrer” recommends the same prospective customer, the first one to make the referral will be entitled to the Reward. In the event of a dispute, the decision of EFL shall be final and binding on the Referrer.
  • The Referrer understands that EFL may contact the person/s referred to Programme its range of products and services. At the time of making a referral under the Program, the Referrer will ensure that the consent, to refer and share his/her/their contact details to EFL, has been obtained from the person so referred for the purpose of availing the EFL’s products and services. The Referrer agrees and undertakes that he/she shall be responsible to the EFL for any losses or claims that may be occasioned upon EFL, in the event that such declaration is found to be false or incorrect. The Referrer undertakes that he/she shall not refer person/s who are not known to him/her.
  • The Referrer understands and agrees that EFL might contact the Referrer for any communication with regards to the Program. This will override any Do Not Disturb (DND) registry or National Customer Preference Register (NCPR) that the Referrer may be a part of.
  • The Customer may choose to refer friends, relatives and business associates using personal media modes such as phone call, email, SMS or Whatsapp or social media modes such as Facebook, Linkedin, Twitter, Instagram or as indicated in the program. In all these modes of referrals, a unique referral link (“url”) and referral code i.e. the unique identifier for the referrer would be generated which will be specific to the Referrer. For every successful referral obtained, the Referrer would be eligible for the Rewards as specified under the Program. For ensuring that the Rewards are paid out to the Referrer, it is essential that the referral code / URL generated is not altered in any manner. If the Referrer or the person referred alters the url/Code, EFL would not be able to authenticate the Referral, as being unique to the Customer, and hence Referrer will not receive any Reward. For any Reward to be made to the Referrer, it is mandatory that:
    - The referred person applies the referral code sent by the Referrer at the time of Checkout
    - The referral is being made using the online referral form where the referred person’s name and details are shared by the Customer post due consent is obtained by the Referrer from the referred person.
    - The referral is being made using the JOS app by an EFL Direct salesperson
  • Referral codes are valid only till the programProgramme is active.This programme is not applicable to channel partners Outlet, Dealers, Distributors, Sales Executives, Outlet, Dealership and employees and their family members and its affiliate / associate / subsidiary companies and their suppliers, advertising agencies and event Management Company of EFL.
  • EFL reserves the right, at any time, with/ without notice to add / alter / modify / change or vary or to replace, wholly or in part, any of the terms and conditions of this Program without prior notice and the same shall be binding on the Referrer at all times.
  • Applications already under process with EFL prior to being referred will not be eligible for any benefits/Rewards under this Program. No payout shall be due on such referrals.
  • The Referrer shall be responsible for the accuracy of the information provided to EFL.
  • The Referrer will not be eligible for Reward if it is found that he/she has referred himself/herself under this Program or if the referred customer already is a registered EFL customer.
  • Notwithstanding anything contained herein, EFL reserves the right to modify, withdraw or cancel the Program, at any time at its absolute discretion without prior notice or without having to give a reason thereof and without compensation whatsoever.
  • Further, EFL reserves the right to reject any claim in the event of irregularity, discrepancy, or dispute and that its decision shall be final, conclusive and binding.
  • All Rewards and payments are subject to the completeness and authenticity of information provided in the Referral Form by the Referrer.
  • In case it is discovered at a later stage that the Referrer has violated any of these terms and conditions or in case it is discovered that the Referrer has engaged in an illegal, wrongful act under the local laws, regulations, for generating successful disbursal, then EFL shall be at liberty to initiate such action as it may deem fit.
  • By participating in this Program, the Referrer represents that he/she is authorized and competent to engage in referring person/s to EFL for availing EFL’s products and services.
  • Customers participating in this Program shall be deemed to have read, understood and accepted these terms and conditions.
  • Referral rewards per applicant is capped at 10 valid referral applications per individual during the Programme duration
  • Contact Number and Email ID of the Referrer should be different from the Customer using the Referral Code to place order. If these details are found to be same, EFL would not be able to authenticate the Referral, as being a valid one, and hence Referral will not receive any Reward.
  • EFL reserves the right to, without liability or prejudice to any of its other rights, at any time, without previous notice and from time to time, withdraw/suspend/amend/cancel this ProgrammeProgramme with or without any reason
  • Nothing contained in these terms and conditions, nor the running of this Programme to which they apply, shall be construed as an obligation on EFL to continue the Programme up to, on or after the time the Programme Period ends
  • The Terms & Conditions shall be governed by the Laws of India. Any dispute arising out of this Programme shall be subject to the exclusive jurisdiction of competent courts in Mumbai
  • Validity of the coupons will be mentioned on them explicitly.
  • Coupons or E-Vouchers are handled by third parties and EFL doesn’t hold any responsibility for these coupons/ vouchers.
  • EFL shall not be, in anyway, responsible if a Coupon code is lost, stolen or misused.
  • Coupon codes are valid for a maximum period of 15 months from the date of issue.
  • Coupon codes cannot be exchanged for cash.
  • Each coupon code can be used only once. If the value in a coupon is not fully utilised for any transaction, then the unutilised value stands forfeited and cannot be refunded.
  • Any reversal of the sale either by referrer or the referee automatically invalidates the coupon issued for such a transaction.
