Terms and Conditions for Euroclean – ‘Diwali Celebrity Meet & Greet’ Contest

1. Eureka Forbes Limited, (hereinafter referred to as "Eureka Forbes/Company") is holding a contest on the occasion of “Euroclean – Diwali Celebrity Meet & Greet Contest” (hereinafter referred to as "the Contest”) on 10th October 2019 (hereinafter referred to as "Contest Period") throughout India except in the states where prohibited by law"). No other contest shall be clubbed with this contest. The contest duration to participate is from 10th October to 25th November 2019. The winners will be announced latest by 1st December 2019 via a lucky draw contest.

2. The contest is valid for Indian Residents who are 18 years or above, except employees and family members of Eureka Forbes and its affiliate/associate/subsidiary companies and their suppliers, advertising agencies and Event Management Company.

3. To participate in this contest, the participant is required to ‘Book a Free Home demo for Euroclean Vacuum Cleaners on www.eurekaforbes.com and post a picture of the Euroclean demo taken at their home as a picture and post it on any one of the official Eureka Forbes pages mentioned below with the hashtag #IsYourHomeDiwaliReady 
Facebook, Instagram, Youtube, Twitter.

4. Eureka Forbes reserves the right to pull out any entry during any given point of the contest period if deemed inappropriate.

5. Participating in “#IsYourHomeDiwaliReady” contest implies that you agree to all Terms & Conditions of the Contest. On completion of the contest, 10 winners will stand a chance to meet celebrities Divyanka Tripathi and Vivek Dahiya (hereinafter referred to as “Gratification”. The gratification shall be selected at the sole discretion of Company.)

6. If the winner resides outside Mumbai only then he/she is eligible for a return economy class air ticket which will be either purchased by the Eureka Forbes or reimbursed to the winner, whichever is cheaper. The return ticket purchased will be on the same day of the event of ‘Meet and Greet’. Eureka Forbes will not be providing stay/accommodation facility. If the winner wishes to extend his/her stay beyond One day then he/she can do so at his/her own cost. In which case, the return ticket date can be mutually agreed upon by Eureka Forbes and the winner.

7. The winners will be announced latest by 1st December 2019 via a lucky draw contest. After winner announcement, the winners must send their contact details registered on Facebook, Twitter and/or Instagram with the location to Eureka Forbes within 48 hrs to be eligible to receive their gratification. In the event that a winner is unreachable, ineligible, or fails to claim the Prize in the time required, Eureka Forbes shall forfeit their Gratification.

8.Entries should not (i) contain any inappropriate, harmful, vulgar, obscene, derogatory, pornographic, abusive, harassing, threatening, hateful, objectionable or offensive language or content; or (ii) should not violate the rights of any party; or (iii) contain anything which, if published, would adversely affect the reputation of Eureka Forbes.

9. This contest is in no way sponsored, endorsed or administered by, or with Facebook/Twitter/Instagram. The participant is providing their information to Eureka Forbes and not to Facebook/Twitter/Instagram. By participating in the contest, the participant hereby consents to the accessing of personal information and/or images/ or videos of the user on Facebook/Twitter/Instagram by Eureka Forbes and/or its event management company for the purpose of this contest. Further, Eureka Forbes shall be at liberty to use the entries received for its media coverage, advertisement or publicity in any form which is existing today or will be known anytime in the future without any further intimation and consideration to the participants including the promotion of any products manufactured, distributed and/or supplied by it.

10. The participation in the contest is voluntary. Participation in this contest constitutes acceptance of these terms and conditions. By participating in this contest, participant agrees to receive communication(s) from Eureka Forbes and/or its event management company relating to the contest and participant unconditionally agrees not to make any claim or raise any complaint against Eureka Forbes and/or the event management company in this respect.

11. All winners are subject to verification, including without limitation, verification of eligibility through checks as deemed appropriate by Eureka Forbes and complete compliance with these terms and conditions; Eureka Forbes reserves the right to verify the winner's details either on its own or through its authorized agency/person and the winner shall provide all necessary assistance in such verification. In exercising this right, Eureka Forbes may ask the winner to provide any documentary or another form of evidence, and if evidence does not establish the same then Eureka Forbes, in its sole discretion, will have the right to disqualify the winner.

12. Eureka Forbes shall not be responsible for system outages, delays, equipment malfunctions, errors or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled or deleted transmissions or other technological difficulties or any other force majeure event that may prevent a participant from participating in the Contest. Further, Eureka Forbes will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or entries or prizes; (c) any computer or communications-related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Contest or (f) any delay, damage, non-receipt, lost, misrouted delivery of products and/or service.

13. The winners are expected to reach at the pre-decided ‘Meet and Greet’ venue on the given time which will be communicated by Eureka Forbes. Eureka Forbes will not be liable for delay of winners arriving late due to personal reasons and no time extension will be possible. Winners will get an opportunity to spend 10-15 minutes (may change in case of emergency) with Celebrities Divyanka Tripathi and Vivek Dahiya. No selfies will be allowed with the celebrities.

14. In the event of any conflict or inconsistency regarding any instructions, rules, and conditions on any advertising or promotional material relating to the contest, these Terms and Conditions shall prevail over all such other instructions, rules and conditions.

15. The gratification cannot be exchanged for any other prizes, product or item, is non-transferable and cannot be en-cashed under any circumstances. Eureka Forbes shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.

16. By participating in the contest, each participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the contest the participant warrants that all information provided by the participant regarding its name, age, state, city, address, phone number, etc., is true, correct, accurate and complete and that the participant is authorized to provide such information and consents to the use of such information by Eureka Forbes and/or its event management company.

 

17. Eureka Forbes reserves the absolute right to amend the terms and conditions of the contest or extend the contest Period or cancel or discontinue the contest or any part thereof without giving any reasons or prior notice. Eureka Forbes reserves the right to substitute the gratification for this contest with prizes of equivalent value, at its sole discretion. Under exceptional circumstances if Eureka Forbes is unable to conduct the ‘Meet and Greet’ contest then the winners will be compensated by means of Amazon gift vouchers worth Rs. 10,000 each.

 

18. The contest shall be void in any state where prohibited by law. In such case, Eureka Forbes shall not be liable to provide any free cash-back, gift(s) or compensation to the participant on any account.

 

19. Failure by Eureka Forbes to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

20. By entering the contest, the participant agrees that Eureka Forbes shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or avail of any gratification (except any liability which may not be excluded under applicable law).

 

21. The decision of Eureka Forbes in relation to the contest and matter incidental thereto shall be final and binding on the customer. The dispute, if any, in respect of the contest should be sent in writing to Grievance Officer, Eureka Forbes Limited, B1/B2, 701, 7th Floor, Marathon- NextGen, Marathon Innova, Off Ganpatrao Kadam Marg, Lower Parel, Mumbai - 400013, India. The existence of a dispute, if any, shall not constitute a claim against Eureka Forbes. Any and all disputes, controversies, and conflicts ("Disputes") arising out of the Contest shall be referred to Courts of Mumbai Jurisdiction.

 

22. This Contest is subject to laws of India including tax regulations as may be applicable to the winner as per eligibility criteria.

 

23. Any tax liability in respect thereof shall be to the account of the winner.

 

24. Eureka Forbes Limited reserves the right to withdraw, change, alter & modify the service & whatsoever mentioned in contest any time with or without notice on Regulatory reasons and/or any other reasons without any liability to the consumer. The winner shall be liable to pay applicable TDS, Goods and Service Tax, Sales Tax & all other applicable taxes& any other amendments in respect thereof.
